Terms of Use

These Terms of Use govern your use of the Nova FTP Manager mobile application (the “App”) published by novalab (“we”, “us”, “our”). By downloading or using the App you agree to these Terms.

Licence

We grant you a personal, non-transferable, non-exclusive licence to install and use the App on Apple devices that you own or control, subject to Apple’s App Store Terms of Service.

Acceptable use

You agree not to:

• Use the App to access systems, networks or data without the owner’s authorisation.
• Use the App to distribute malware or content that infringes intellectual property rights.
• Reverse engineer, decompile or attempt to derive the source code of the App, except to the extent permitted by applicable law.
• Use the App in violation of any applicable law, including export control and sanctions regulations.

Your content

The App is a tool that transmits files between systems you control. We do not claim any rights in those files, and we do not access, store or process them. You are solely responsible for the content you transfer using the App and for ensuring you have the right to transfer it.

Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that file transfers will be free from error, loss or interruption.

Limitation of liability

To the maximum extent permitted by applicable law, novalab shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or revenues, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages. Where liability cannot be excluded, our total liability is limited to the amount you paid for the App in the twelve months preceding the claim.

Updates

We may release updates to the App from time to time. Updates may add, change or remove features. We may also discontinue the App at our discretion.

Changes to these terms

We may update these Terms from time to time. The “Last updated” date reflects the most recent change. Continued use of the App after changes constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of Jersey, Channel Islands, without regard to conflict-of-laws principles. Disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of Jersey, Channel Islands, except where mandatory consumer-protection laws of your country of residence apply.
